Tyche Capital is run by three university graduates. We are not registered with SEBI in any capacity, we are not a company or a fund, we do not accept money from anyone, and nothing on this Site is investment advice or a recommendation. Please read Sections 2 and 5 below and our Risk Disclosure before relying on anything you read here.
These Terms of Service (“Terms”) govern your access to and use of tychecapital.co.in and its subdomains, including our research notes, research archive, performance figures and any account you create (together, the “Site”).
These Terms are an electronic record under the Information Technology Act, 2000 and do not require a physical or digital signature. By creating an account you agree to them. By using the Site without an account you also agree to them; if you do not agree, please do not use the Site.
These Terms should be read with our Risk Disclosure and Privacy Policy. Both form part of these Terms.
The Site is run by three university graduates based in Bengaluru, Karnataka: Kushagra Agarwal, Vedansh Mishra and Ankith Bharadwaj (“we”, “us”, “our”). “Tyche Capital” is a name we use. It is not a company, limited liability partnership, registered firm or any other legal entity, and these Terms are an agreement between you and the three of us as individuals.
We are not registered with the Securities and Exchange Board of India (SEBI) in any capacity, including as a research analyst, investment adviser, portfolio manager, mutual fund, alternative investment fund or collective investment scheme. We hold no professional qualification or licence in finance, law or tax.
We do not accept money from anyone. We do not take investments, deposits, fees, subscriptions or donations, and we do not manage money for anyone other than ourselves. The portfolio whose performance appears on the Site contains only our own money and cannot be joined.
You may read the public pages of the Site at any age.
You must be at least 18 years old, and legally able to enter into a binding contract under the Indian Contract Act, 1872, to create an account. By creating an account you confirm that you are.
You may not use the Site if doing so is prohibited by the laws that apply to you.
Accounts are free and give access to our research archive. An account gives you no rights in, or information about, any portfolio, and no right to any service beyond access to the archive.
You must give a genuine email address, keep your sign-in details confidential, and tell us promptly if you believe your account has been used without your permission. You are responsible for activity on your account that results from your failure to keep your sign-in details secure.
One account per person. Accounts are personal and may not be shared, sold or transferred.
You may delete your account at any time, using “Delete account” on your account page or by emailing any of us from your registered email address. Deletion is permanent. If records on the Site are linked to your account, the account page will ask you to email us instead, and we will close it for you.
Everything on the Site is for educational and informational purposes only. Nothing on the Site is, or should be treated as:
- investment, financial, legal, tax or accounting advice;
- a research report or recommendation, including a “buy”, “sell”, “hold”, “subscribe” or “avoid” rating or a price target, in respect of any security or public offer;
- an offer or solicitation to buy or sell any security, or to invest with us or in any scheme or arrangement;
- advice suited to your personal circumstances.
Our research is our opinion, based on publicly available information that we have not independently verified. It may be wrong, incomplete or out of date. We may hold the securities we write about. See the Risk Disclosure.
You are solely responsible for your own investment decisions. You agree not to rely on anything on the Site as the basis for an investment decision, and to consult a SEBI-registered investment adviser before making one.
Performance figures on the Site relate only to our own money, are unaudited, and are presented as described in Section 6 of the Risk Disclosure. Past performance is not a reliable indicator of future results.
The text, analysis, charts, design and other original content on the Site are owned by us and protected by the Copyright Act, 1957. Company names, logos and trade marks mentioned on the Site belong to their respective owners; we use them only to identify the companies we write about, and their use does not imply any affiliation or endorsement.
We give you a personal, non-exclusive, non-transferable, revocable licence to view the Site and to download or print content for your own personal, non-commercial use.
You may quote short extracts from our research, with clear attribution to “Tyche Capital” and a link to the original note. You may not:
- copy, republish, sell or distribute our content in full or in substantial part;
- use our content in any paid product, service, course, newsletter, “tips” channel or advertisement;
- present our content, or any part of it, as a recommendation, or as your own work.
You agree not to:
- scrape, crawl, harvest or systematically download content from the Site, including for training machine-learning models, without our written permission;
- attempt to gain unauthorised access to the Site, other accounts, or the systems behind them, or interfere with the Site’s security or operation;
- impersonate us or anyone else, or suggest that you are connected with or endorsed by us when you are not;
- use our names, the name “Tyche Capital”, or our content to solicit money or investments from anyone;
- use the Site in breach of any law, including the Information Technology Act, 2000 and securities law, or to spread false or misleading information about any security;
- introduce any virus, malware or harmful code.
The Site may contain links to, and data from, third parties such as stock exchanges, company websites, regulators and data providers. We do not control them and are not responsible for their content, accuracy, availability or privacy practices. A link does not mean we endorse the linked site.
The Site is provided free, “as is” and “as available”. We do not promise that it will be available, uninterrupted, secure or free of errors, and we may change, suspend or discontinue any part of it (including the research archive) at any time without notice.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, completeness, timeliness, merchantability and fitness for a particular purpose.
To the fullest extent permitted by law, none of us is liable to you, whether in contract, tort (including negligence), under statute or otherwise, for:
- any investment or trading loss, or any loss arising from any decision you take or do not take, in reliance on anything on the Site;
- any loss of profit, opportunity, data or goodwill;
- any indirect, incidental, special or consequential loss;
- any loss caused by the unavailability of the Site, errors in third-party data, or events beyond our reasonable control.
Subject to Section 10.3, our total aggregate liability to you for all claims connected with the Site or these Terms is limited to ₹1,000 (Indian Rupees One Thousand). This reflects the fact that the Site is provided free of charge.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under Indian law, including liability for fraud, or for gross negligence or wilful misconduct to the extent the law does not permit it to be limited.
You agree to indemnify each of us against any claim, loss, liability, cost or expense (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site or our content.
We may suspend or close your account, or restrict your access to the Site, at any time if we reasonably believe you have breached these Terms or that it is necessary to protect the Site, us or other users. We will tell you why unless the law or a security concern prevents it. Sections 5, 6, 10, 11, 15 and 16 continue after your account is closed.
We may update these Terms from time to time. Changes take effect when published on this page, and the date at the top shows the latest version. We will highlight material changes at the top of this page for 30 days and, for account holders, notify them by email at least 7 days before the change takes effect. If you do not agree with a change, you may delete your account; continuing to use the Site after a change takes effect means you accept it. We keep dated copies of all previous versions and will provide them on request.
If you have a question, complaint or grievance about the Site, email any of us:
We will acknowledge your message within five business days and aim to resolve it within 30 days. For privacy matters, see the Grievance Officer section of our Privacy Policy.
These Terms, and any dispute or claim arising from or connected with them or the Site, are governed by the laws of India.
We will first try to resolve any dispute with you informally and in good faith. If a dispute is not resolved within 30 days of either side notifying the other in writing, then, subject to any right you have under law to approach another forum, the courts at Bengaluru, Karnataka have exclusive jurisdiction.
Severability. If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will continue in full force.
Entire agreement. These Terms, together with the Risk Disclosure and Privacy Policy, are the entire agreement between you and us about the Site and replace any earlier terms.
No waiver. If we do not enforce a right, that does not mean we have waived it.
Assignment. You may not transfer your rights under these Terms. We may transfer our rights and obligations to an entity we incorporate to run the Site, and will notify account holders if we do.
Notices. We may send notices to account holders at their registered email address. You may send notices to us at any of the addresses in Section 14.
No partnership or advisory relationship. Nothing in these Terms creates any partnership, agency, fiduciary, advisory or client relationship between you and us.
